As of January 2008, class actions have been permitted in Norway. Class actions in Norway are procedural rules that may be used to enforce any substantive law. Norwegian class actions may be brought when class members suffer from a similar factual or legal situation. The court determines whether the class action should be an opt-in or opt-out class action. The court may create an opt-out class action if the claims are too small to justify individual actions. In an opt-out class action, all class members belong to the class without having to write in to the court. In an opt-in class action, class members must write in to join a court-maintained register in order to participate in the class action.
